When it comes to the legal operation of an HOA in Texas, there is a hierarchy of how laws are applied. From highest to lowest authority, it is:

1. Federal Laws:
a. HUD Housing and Community Development (HCD) Act of 1974 --> link
b. FEMA flood zone building --> link
c. Disability Rights Laws --> link
d. Fair Housing Laws --> link
e. Over-the-Air Reception Devices Rule (OTARD) --> link
f. Freedom To Display US Flag Law --> link

2. Texas State Laws:

5. Homeowner Association 'Rules'
a. Publicly recorded subdivision plat map, with easements and common areas (if any) designated.
b. Declaration of Covenants, Conditions, & Restrictions aka: deed restrictions, CC&R's
c. Articles of Incorporation aka: HOA Certificate of Formation
d. Bylaws
e. Any Homeowner Association Rules aka: guidelines, policies, meeting rules (ie: Roberts Rules of Order).

Legislative changes made during the 82nd Session of the Texas Legislature that have not been included in the text of the Texas Statutes as of this writing, but have gone into effect:

Changes to Section 5 Property Codes by --> HB 1821

Changes to Section 51 Property Codes by --> SB 101

Changes to Section 202 Property Codes by --> HB 362, --> HB 1278, --> HB 2779

Changes to Section 209 Property Codes by --> SB 472, --> HB 1228, --> HB 2761, and --> SB 472

Changes to Section 210 Property Codes and 212 Property Codes by --> HB 1071

Changes to Section 211 Property Codes by --> HB 232

Changes to Section 215 Property Codes by --> HB 2869
